1. Introduction

These Terms and Conditions (hereinafter referred to as "Agreement") govern the use of Short Message Service (SMS) communication services (hereinafter referred to as "Service") provided by us. (hereinafter referred to as "Provider") to the recipient (hereinafter referred to as "Client").

2. Eligibility and Age Restriction

The SMS Service is intended for individuals who are 18 years of age or older. By opting into the Service, the Client represents and warrants that they are at least 18 years old and have the legal capacity to enter into this Agreement. The Provider does not knowingly collect information from or send SMS messages to individuals under the age of 18. If we become aware that we have collected information from a minor, we will promptly delete such information and discontinue communications.

3. Client Consent

By agreeing to these terms and conditions, the Client provides explicit consent to receive SMS messages from the Provider for the purpose of communication, notifications, alerts, and updates. The Client acknowledges that these messages may be of a transactional, informational, or promotional nature.

4. Frequency of Messages

The Provider agrees to send SMS messages to the Client only as necessary and in accordance with applicable laws and regulations. The frequency of messages will be kept to a reasonable minimum, considering the purpose of communication.

5. Opt-Out Mechanism

The Client has the right to opt-out of receiving SMS messages from the Provider at any time. To unsubscribe, the Client can reply to any SMS message with the word "STOP" or follow the instructions provided in the message. Upon receiving this request, the Provider will cease sending SMS messages to the Client.

6. Data Usage and Privacy

The Provider respects the Client's privacy and will handle personal information in accordance with its Privacy Policy. By agreeing to these terms and conditions, the Client acknowledges and consents to the collection, storage, and use of their personal information as described in the Privacy Policy.

7. Costs and Charges

Standard messaging rates from the Client's mobile carrier may apply for receiving SMS messages. The Provider is not responsible for any charges incurred by the Client from their mobile carrier.

8. Carrier Liability Disclaimer

The Client acknowledges and agrees that mobile carriers (including but not limited to AT&T, T-Mobile, Verizon, Sprint, and other wireless service providers) are not liable for delayed, undelivered, or failed SMS messages. The Provider is not responsible for any technical issues, delivery failures, message delays, or service disruptions caused by the Client's mobile carrier, network outages, or any other circumstances beyond the Provider's reasonable control. SMS messages are transmitted on an "as-is" and "as-available" basis, and neither the Provider nor any participating mobile carrier guarantees the delivery, accuracy, or timeliness of any message.

9. Service Availability

The Provider will make reasonable efforts to ensure the availability and reliability of the SMS Service. However, the Provider is not liable for any disruptions, interruptions, or delays in the Service that are beyond its control.

10. Termination

The Provider reserves the right to terminate or suspend the SMS Service to the Client at any time and for any reason, without prior notice.

11. Changes to Terms and Conditions

The Provider may modify or update these terms and conditions at its discretion. It is the Client's responsibility to periodically review this Agreement for any changes.

By providing your consent to receive SMS messages from us, you acknowledge that you have read, understood, and agreed to these terms and conditions.
